just a matter of curiosity: you guys there run a label (nwn, darker than black, dark descent, invictus, iron tyrant, iron bonehead, blood harvest, etc etc etc) do request a physical cotract from the bands you sign, or everything is based on verbal agreements?
I like to keep that romantic feeling where UG metal is a cultural gueto where a man's word still keeps a
level of relevance, but off course it's not always this way. neverless, as abose said, I'm asking just for curiosity after all  |

As a lot if UG deals transcend borders trying to initiate legal action is sort of futile. I guess everyone knows it too. The one reason i was in favour of written contracts was detailing who owns the recording and specifically that you arent relinquishing rights to the songs themselves.
Otherwise the labels put it out and pay for what they agree to (see Hells Headbangers) or you get Agonia-ed. _________________ Ashes to ashes

It depends on whether you're in it for the money or not (both on the labels and bands' side.)
I released stuff before, I'll release some again. No signed contract ever, for the same reason Ole mentioned. |

In my experience even written contracts can amount to shit so it seems fairly academic in the context of the "deals" between small Metal bands and small independent labels. _________________

no, that's actually not the point at all. the point is to hold people to their responsibilities in a formal manner. i don't think a contract is always necessary - my contracts with bands have been verbal ones, or informal in emails - but just because you do a contract doesn't mean you're "in it for the money".
personally, as an artist, i'm not interested in having my releases be a "benefit" for the label, i.e. no agreement is made and they wind up keeping all the profit for whatever reason. it has turned out that way before, even with a contract. contracts don't mean shit if one or more of the parties are unscrupulous.
usually if somebody has a bad business reputation, it's worth investigating before you get involved.
for example, it's becoming fair to conclude that doing business with blake judd might be a bad idea. unless you're, like, "not in it for the money". _________________ http://www.ugEXPLODE.com

Verbal vs. Written contract in underground metal?
Seems to me that you are best suited to rely on your instincts and do your best to judge the integrity of your potential contractual partner. ...based on various threads throughout the years seems like neither method (word or writ) is a perfect defense against being possibly screwed.
And if you are willing/able to pursuse the matter in court and do win, how do you collect whats owed from someone that has nothing but track marks? Courts decide the winner, they do not collect the bounty for you do they? |
